{"id":24311,"date":"2020-11-01T15:56:25","date_gmt":"2020-11-01T21:56:25","guid":{"rendered":"https:\/\/www.midwestfarmreport.com\/?p=24311"},"modified":"2020-10-30T06:53:36","modified_gmt":"2020-10-30T11:53:36","slug":"dairy-industry-asks-fda-once-again-to-enforce-labeling-rules","status":"publish","type":"post","link":"https:\/\/www.midwestfarmreport.com\/2020\/11\/01\/dairy-industry-asks-fda-once-again-to-enforce-labeling-rules\/","title":{"rendered":"Dairy Industry Asks FDA Once Again to Enforce Labeling Rules"},"content":{"rendered":"\n<p><strong><em>The following article is courtesy of the National Milk Producers Federation.<\/em><\/strong><\/p>\n\n\n\n<p>With FDA giving little indication of <a href=\"https:\/\/www.nmpf.org\/likely-incoming-fda-chief-gives-hope-that-fake-milk-resolution-may-be-near\/\">promised action<\/a> on proper labeling of imitation dairy products, the National Milk Producers Federation today asked the agency\u2019s ombudsman to ensure that rules are properly enforced.<\/p>\n\n\n\n<p>\u201cAllowing unlawfully labeled \u2018plant-based\u2019 imitation dairy foods to proliferate poses an immediate and growing risk to public health; it is a clear dereliction of the FDA\u2019s duty to enforce federal law and agency regulations,\u201d wrote NMPF President and CEO Jim Mulhern in <a href=\"https:\/\/www.nmpf.org\/wp-content\/uploads\/2020\/10\/FDA-Ombudsman-October-28-NFN.pdf\">the letter<\/a>, sent to Dr. Laurie Lenkel, ombudsman for the U.S. Food and Drug Administration. \u201cThe FDA\u2019s Office of the Ombudsman must intervene to break the bureaucratic logjam that is adversely affecting consumers. Doing so would fit squarely within the Office\u2019s own mission to ensure even-handed application of FDA policy and procedures.\u201d<\/p>\n\n\n\n<p>The FDA ombudsman, based in the agency commissioner\u2019s office, \u201cserves as a neutral and independent resource for members of FDA-regulated industries when they experience problems with the regulatory process,\u201d according to <a href=\"https:\/\/www.fda.gov\/about-fda\/office-chief-scientist\/office-ombudsman\">the agency<\/a>. NMPF is urging the ombudsman\u2019s office to take appropriate action to remedy the FDA\u2019s lax approach to enforcing its own rules on the use of dairy terms on products containing no dairy ingredients, which have proven impacts on public health \u2013 a new phase of advocacy brought about by the agency\u2019s regrettable inaction. The American Academy of Pediatrics and other organizations have <a href=\"https:\/\/www.regulations.gov\/document?D=FDA-2018-N-3522-10781\">offered evidence<\/a> of nutritional deficiencies caused by confusion over the contents of plant-based versus dairy beverages.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.nmpf.org\/nmpf-road-map-petition-to-fda-outlines-next-steps-in-dairy-labeling-rules\/\">NMPF last year<\/a> released its own road map offering solutions to how public health, product integrity and free speech could be protected through updated regulations. NMPF also supports the <a href=\"https:\/\/www.nmpf.org\/nmpf-backs-dairy-pride-act-calls-for-fda-action-on-fake-milks\/\">DAIRY PRIDE Act<\/a>, a potential legislative prod for FDA action, and has <a href=\"https:\/\/www.nmpf.org\/dairy-defined-an-open-letter-to-fda-commissioner-dr-stephen-hahn\/\">asked FDA commissioner<\/a> Dr. Stephen Hahn to follow up on <a href=\"https:\/\/www.nmpf.org\/nmpf-thanks-sen-baldwin-for-advocacy-encouraged-by-dr-hahns-dairy-response-at-fda-hearing\/\">the pledge<\/a> he made nearly one year ago to make fake-dairy labeling a high-priority issue at FDA.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The following article is courtesy of the National Milk Producers Federation.
